Dear USET/USET SPF Family,
The Native American Rights Fund is seeking Tribal Nation signatories to an Amicus Brief in the case Brackeen v. Haaland. In this case, the 5th Circuit of the U.S. Court of Appeals invalidated portions of the 1978 Indian Child Welfare Act (ICWA) ruling that the provisions of the law violate the rights of the state of Texas. The Amicus Brief provides the Supreme Court with background on ICWA, its importance to Indian Country and Native children and families, and the dangers of dismantling ICWA.
USET SPF continues to join a critical mass of Tribal Nations and partner organizations in efforts to defend the constitutionality of ICWA and its implementing regulations, including through the support of amici efforts. We plan to become signatories to the brief and encourage our member Tribal Nations to join, as well.
The deadline to sign on to the Brackeen Amicus Brief is next week, Tuesday, August 9th. If your Tribal Nation would like to sign on and support the Brackeen Amicus Brief, please contact NARF Attorneys Dan Lewerenz at lewerenz@narf.org, and Erin Dougherty dougherty@narf.org.
For more information, please contact Brian Howard, USET SPF Senior Policy Analyst, at bhoward@usetinc.org.
