Dear USET/USET SPF Family,
On January 7, 2022 the Department of Labor’s Occupational Safety and Health Administration (OSHA) issued a Dear Tribal Leader Letter announcing a Tribal consultation on the COVID-19 vaccination and Emergency Temporary Standard (ETS). Previously, OSHA hosted a Tribal Leader Briefing on the COVID-19 vaccination and ETS on November 5, 2021. Following the Tribal Briefing, OSHA decided not to enforce the ETS to apply to “traditionally governmental” Tribal activities until it consulted with Tribal Leaders to receive input on the applicability and implications of the ETS. Therefore, this consultation is focused on receiving input from Tribal Leaders on ETS enforcement on worksites owned by Tribal Nations and its applicability and implications for Tribal Nations.
