The U.S. Department of the Treasury has issued a Dear Tribal Leader Letter announcing that it will be hosting a Tribal consultation on a Notice of Proposed Rulemaking (NPRM) for the Clean Electricity Low-Income Communities Bonus Credit Amount program. The NPRM will be published in the Federal Register on Tuesday, September 3, 2024.
The Clean Electricity Low-Income Communities Bonus Credit Amount Program was created under the Inflation Reduction Act (P.L. 117-169) to promote cost-saving clean energy investments in low-income communities and Tribal lands as part of affordable housing developments. The NPRM proposes to address technology neutral versions of the Low-Income Communities Bonus Credit Program under current regulations of the IRS Code, as well as replacing and combining certain sections of its regulations. This NPRM also addresses the future “technology neutral” bonus credit for Indian lands and Tribal housing projects.
