Resignation After Maternity Leave - Update 1

QUESTION

Dear all,

One of our employees is supposed to report work on 8th May 2017 after her maternity leave. However, she called and explained that her new born needs additional attention and will like to resign. She will come back office to pick up her things in a few days time but never mention she will give company's notice. Under such circumstances, what should the company do? Ask her to pay for the 1 month salary?

Yes, we will do so, either serve notice or pay notice in lieu.

But she already gave a good reason that the new born requires her attention. To tidy up your HR filing I will like to suggest that you advise her to back up her reason with a doctors certification. That is honourable. She can't possibly pay back in liew of notice because the event that happened to her, i.e., childbirth and further child health complications also did not give notice. You should quietly look away. Otherwise, you may end up costing your employer more than you were trying to save.
