GROUP INSURANCE PLAN

NON-PAYMENT OF AN INSURED EMPLOYEE’S PREMIUMS
ARTICLE 47 OF THE PRESCRIPTION DRUG INSURANCE ACT:
“An insurer or plan administrator of an employee benefit plan cannot terminate the contract or the prescription drug insurance component only if the policyholder or member is in default of paying the premium or the contribution. In this case, termination cannot be made before the expiration of a period of 30 days from the transmission by the insurer or administrator of a notice of intention to the last known address of the lessee or of the member. A copy of this notice must be sent to the RAMQ. »
As stipulated by the Act respecting prescription drug insurance, being a beneficiary of group insurance, an employee cannot benefit from RAMQ drug insurance. Given that during disability, preventive withdrawal, maternity leave, paternity leave and/or parental leave the employment relationship is not severed, the employee must remain covered under the group insurance plan in place in the company.
A copy of the notice sent by registered mail must be sent to the RAMQ and to the existing insurer.
