Connecticut patients can now sue healthcare providers for privacy violations or PHI disclosure

The Connecticut Supreme court has ruled that patients have the right to sue healthcare providers for privacy violations and if unauthorized Protected Health Information (PHI) disclosure takes place. Though HIPAA does not permit individuals to sue healthcare providers for HIPAA violations, Connecticut is now the fourth state after New York, Missouri and Massachusetts, to allow patients to file lawsuits against healthcare providers over unauthorized and negligent disclosures of medical records.

This new legal precedent for the state was set by Supreme Court in the case of Byrne v. Avery Center for Obstetrics & Gynecology (ACOG). Emily Byrne sued ACOG for negligence and breach of contract after the provider released her medical records in response to a subpoena issued as part of a separate paternity case filed by her ex-boyfriend seeking custody of her child.

Allscripts sued over ransomware attack, accused of 'wanton' disregard

EHR Vendor Allscripts went down on Jan. 18, after two of its data centers in Raleigh and Charlotte, North Carolina fell victim to SamSam ransomware. Just one week after some of Allscripts’ services were shut down by ransomware, the EHR giant is facing a lawsuit for allegedly failing to secure its systems and data from cyberattacks. Boynton, Beach, Florida-based Surfside Non-Surgical Orthopedics is suing Allscripts on behalf of all clients impacted, as the system outage resulted in canceled appointments, care disruptions and "significant business interruption and disruption and lost revenues.”


New HHS Secretary Alex Azar: Will He Shake Up Priorities?

Alex Azar, a former Eli Lilly executive who also previously served as HHS deputy secretary and general counsel is the newly confirmed secretary of the Department of Health and Human Services.The secretary sets departmental priorities - so Alex Azar will have an enormous impact on the priorities of the Office for Civil Rights and Office of the National Coordinator for Health IT, potentially more so than for other parts of HHS, because OCR and ONC are both actually part of the Office of the Secretary.  Azar, has the potential to reset critical national healthcare priorities and policies, including those related to security and privacy. But what action will he take regarding HIPAA enforcement and other related issues?
