Today, the Department of the Treasury has issued a Dear Tribal Leader Letter
announcing Tribal consultations on the Tribal General Welfare Exclusion (GWE) Act of 2014 and the Treasury Tribal Advisory Committee’s (TTAC) Report on GWE. Yesterday, TTAC’s Subcommittee on the Tribal General Welfare Exclusion Act submitted the Report for consideration by the TTAC, which was accepted and referred to Treasury for Tribal consultation purposes before the report can be finalized and submitted to the Secretary of the Treasury.
The Report outlines core principles for consideration regarding implementation of GWE and cites specific issues for consideration in developing further guidance. The Tribal consultation dates and times for the TTAC Report on GWE are as follows—
USET SPF submitted comments
to the TTAC Subcommittee on the Tribal General Welfare Exclusion Act on September 14, 2020 in response to a solicitation for input on developing recommendations for GWE guidance. We emphasized that in addition to flexibility for Tribal Nations designing and administering GWE programs, Treasury must also support our self-determination to administer GWE programs in any manner we see fit to best serve our communities. We also stressed continued Tribal consultation, especially in developing Internal Revenue Service Field Agent training, no GWE benefits impact to eligibility for other federal programs, and that Treasury guidance on other programs should comport with GWE.
