The new Labour Code comes into force on 1 July 2017

Please be informed that as from 1 July 2017 the new Labour Code of the Republic of Lithuania comes into force (hereinafter – NLC). The main objective of the new legal regulation is to liberalize the legal regulation of the employment relationship, as well as establish more flexible working relationship between an employer and an employee. In order to achieve the objective referred a large part of the rules are not laid down in the NLC, therefore, the companies are required to establish various orders in their internal documents.

How to protect business from becoming involved in tax fraud?

The State Tax Inspectorate (hereinafter - STI) published recommendations, which provide some guidelines regarding how to protect business activities from being involved in transactions connected with tax fraud. The recommendations are based on the European Union Court of Justice and Supreme Administrative Court of Lithuania case law.

Court decision regarding transfer of confidential information to third parties

County Court of Šiauliai (hereinafter – the Court) has defined in its decision (Civil Case No. e2A-230-883/2017) the conditions under which the civil liability for breach of obligation not to disclose confidential information (as a breach of the Employment contract) is enforceable. In case the Employee breaches a clause of confidentiality the Employer has a right to claim for the compensation of damages it has suffered.
