Not genuine arrangements and risks that dividends may be taxed

 

On November 2017 the State Tax Inspectorate (hereinafter – the STI) has published the Commentary of the above-mentioned and stated the circumstances, which may be evaluated to determine when the arrangements are not genuine.

The legislation states that dividends paid according to not genuine arrangements which main purpose or one of the main purposes were to receive taxing benefits, may be taxed, i.e. „participation exemption“ may not be applied.

STI commented regarding the application of 0% VAT rate to the transportation services

The State Tax Inspectorate (hereinafter – the STI) released the explanation regarding the European Union Court of Justice (hereinafter – the ECJ) case C-288/16.

The decision of the case needed clarification from the Lithuanian STI, because it contradicted the Lithuanian legislation, regulating 0% VAT rate application to the transportation services, when these services are provided to the freight forwarder, i.e. not directly to exporter/importer of goods.
